These policies form part of the binding contract between you and NextShopper when you create an account, place an order, pay an invoice, or use our Services. Browse all legal documents at /legal.

Acceptable Use Policy (AUP)

This Acceptable Use Policy is part of the Terms of Service. It applies to all Services, Accounts, domains, websites, email, DNS, storage, bandwidth, and APIs provided by NextShopper. Industry-standard hosting AUPs prohibit spam, phishing, malware, and resource abuse; this Policy adopts that structure and adds Bangladesh digital-commerce prohibitions.

1. Lawful use only

You must use the Services only for lawful purposes and in compliance with these Terms, this AUP, the Copyright and Trademark Policy, and all applicable local, national, and international laws and regulations—including Bangladesh law when you or your customers are in Bangladesh.

2. Zero-tolerance prohibitions

You may not use the Services to:

Host, distribute, link to, or promote child sexual abuse material (CSAM) or any sexual content involving minors — zero tolerance; we will suspend and report to competent authorities.
Conduct phishing, credential harvesting, social engineering, or operate fake login pages.
Distribute malware, ransomware, trojans, exploit kits, spyware, or operate botnet command-and-control.
Send spam or unsolicited bulk email; use purchased lists; operate open relays or open proxies; or snowshoe spam.
Engage in fraud, carding, scam stores, investment/advance-fee fraud, or impersonation of persons or brands.
Publish terrorist content or content that incites violent crime as defined by applicable law.
Trade in illegal drugs, weapons, explosives, or other goods/services prohibited under Bangladesh or other applicable law (including Digital Commerce restrictions on prohibited items and unlicensed medicines).
Operate online gambling/betting where prohibited, or lotteries/raffles without required government permission.
Operate large-scale copyright piracy hubs (infringing streaming/download as a primary purpose).
Launch or facilitate attacks on third-party systems (DDoS, unauthorised scanning, brute force), except lawful authorised security research that does not harm others.
Perform cryptocurrency mining on shared hosting without our prior written approval.
Commit resource abuse that degrades service for others (runaway cron jobs, inode flooding, extreme CPU/I/O, outbound floods).
Evade sanctions or engage in prohibited export-controlled activity.
Collect personal data without a lawful basis, notice, and consent where required.
Operate multilevel marketing schemes prohibited under Bangladesh digital-commerce rules via our Services.

3. Email rules

3.1 Authenticate outbound mail (SPF, DKIM, DMARC where available). 3.2 Include a working unsubscribe mechanism for commercial email and honour opt-outs promptly. 3.3 Do not spoof headers or forge sender identities. 3.4 Maintain complaint and bounce rates compatible with major mailbox providers. 3.5 We may rate-limit, quarantine, or block sending that triggers abuse thresholds.

4. Web, storage, and DNS content

4.1 You are solely responsible for content on domains pointing to our hosting or using our DNS. 4.2 Adult content that is lawful in your jurisdiction may still be restricted on shared platforms if it causes excessive abuse load or elevated legal risk—contact us before hosting high-risk categories. 4.3 Do not store or process special-category data at scale unless you have appropriate safeguards and we have agreed in writing.

5. Security obligations

5.1 Keep applications, plugins, and CMS software patched. 5.2 Rotate compromised credentials immediately. 5.3 Do not share hosting Accounts in ways that bypass AUP enforcement. 5.4 Compromised sites used for phishing or malware may be suspended until cleaned, even if you were not the attacker.

6. Investigation and enforcement

6.1 We may investigate abuse reports, scan for malware indicators, throttle resources, remove or disable content, suspend, or terminate Services without prior notice when there is serious risk. 6.2 We may share information with CERTs, registrars, registries, payment partners, hosting upstreams, and law enforcement. 6.3 Refunds are not available for AUP terminations (Refund Policy).

7. Reporting abuse

Report abuse to [email protected] with the subject “Abuse Report”. Include URLs, email headers, sample files/hashes, timestamps, and your contact details. We aim to action credible reports promptly.

8. Changes

We may update this AUP by posting a new version on this page with a revised last-updated date.
