Domain Registration Agreement
This Domain Registration Agreement (“DRA”) applies whenever you register, renew, transfer, restore, or manage a domain name through NextShopper. It supplements the Terms of Service, Registrant Rights and Responsibilities, Domain Fees, and Expired Domain Recovery Policy.
This structure mirrors industry practice for domain resellers: you contract with the reseller for retail service, while the sponsoring ICANN-accredited registrar (for gTLDs) remains the registrar of record.
1. Parties and reseller disclosure
1.1 For gTLDs, your registration is sponsored by an ICANN-accredited registrar. NextShopper is a reseller, not the accredited registrar and not the registry.
1.2 Upon inquiry, we will identify the sponsoring registrar for your domain. ICANN registrant educational materials: https://www.icann.org/resources/pages/benefits-2013-09-16-en
1.3 You appoint Next Shopper IT Solutions LLC as your agent to transmit registration data and commands (create, renew, update, transfer, restore) to the upstream registrar.
1.4 We do not claim to be ICANN-accredited.
2. Incorporation of third-party terms
You agree to be bound by: (a) the sponsoring registrar’s registration agreement and policies; (b) the applicable registry’s policies; (c) ICANN consensus and temporary policies for gTLDs (including Transfer Policy, Registration Data Policy, and UDRP/URS where applicable); and (d) this DRA. Upstream updates apply as of their published effective dates.
3. Accurate registration data
3.1 Provide and promptly update accurate registrant, admin, technical, and billing data. 3.2 Wilful provision of inaccurate data, or failure to update, can lead to suspension or cancellation. 3.3 Respond to registrar or reseller verification inquiries within the required period (commonly fifteen (15) days). 3.4 WHOIS/RDAP publication or gated disclosure follows then-current policy; privacy/proxy options, if purchased, follow Section 7.
4. Fees, term, and renewals
4.1 Fees for register, renew, transfer, restore/redemption, and privacy are disclosed before payment (Domain Fees) and on the Invoice. 4.2 Registration terms are typically one or more years as selected at checkout. 4.3 Renewal is your responsibility even if reminder emails fail. Enable auto-renew where offered if you want automatic attempts to renew. 4.4 After expiry, grace, redemption, and pending-delete periods follow TLD rules; redemption fees can be substantial (Expired Domains).
5. Transfers
5.1 Outbound transfers require a valid auth/EPP code and unlocked status, subject to policy and unpaid-fee holds. 5.2 A sixty (60) day transfer lock (or other lock) may apply after registration or inbound transfer. 5.3 We may deny transfers that violate ICANN/registry policy, court orders, or unpaid obligations for the domain.
6. Use of the domain
You are solely responsible for use of the domain and any website, email, or service on it. Illegal use or AUP violations can result in suspension at NextShopper, registrar, or registry level.
7. Privacy and proxy services
Where privacy/proxy is offered, the service provider’s terms apply. Underlying customer data must remain accurate and available to the registrar as required. We follow upstream registrar specifications and any applicable ICANN privacy/proxy rules.
8. Dispute resolution for domain names
Trademark and cybersquatting disputes for gTLDs may proceed under UDRP, URS, court, or other applicable policies. You agree to be bound by decisions under those procedures. This DRA does not replace them.
9. Suspension and cancellation
Domains may be suspended for AUP violations, legal process, registry/registrar locks, unpaid renewal, or accuracy failures. Successful creates are generally non-refundable (Refund Policy).
10. ccTLDs
Country-code domains follow the local registry’s eligibility, documentation, naming, and dispute rules, which may differ from gTLD practice.
11. Limitation of warranties
Domain availability, continuous DNS resolution, and third-party DNS uptime are not absolute warranties. Liability limits in the Terms apply to the extent permitted by law.
